COLLECTION AND PRIVACY NOTICE TO CALIFORNIA EMPLOYEES AND INDEPENDENT CONTRACTORS REGARDING THE COLLECTION OF PERSONAL INFORMATION

Hyland’s Consumer Health, Inc. (“Hyland’s Naturals” “us” or “we”) adopts this Collection and Privacy Notice to California Employees and Independent Contractors Regarding the Collection of Personal Information (the “Privacy Notice”) to comply with the California Consumer Privacy Act as amended by the California Privacy Rights Act (collectively, the “CCPA”). Any terms defined in the CCPA have the same meaning when used in this Privacy Notice. Hyland’s Naturals is committed to protecting the privacy and security of personal information. This Privacy Notice sets forth our policies and practices for handling personal information we collect and use in the employment context. Hyland’s Naturals, in the regular course of its business, asks employees, and independent contractors (collectively “you” or “your”) to provide personal information relating to their employment or prospective employment with us. This Privacy Notice describes how Hyland’s Naturals collects and uses your personal information, the categories of personal information it collects, and instances where Hyland’s Naturals may disclose your personal information to third parties. Hyland’s Naturals will only collect and process your personal information in accordance with this Privacy Notice, unless otherwise permitted by applicable law.

Personal Information Hyland’s Naturals Collects and How We Use It

Personal Information Collected

Hyland’s Naturals may collect the following categories of your personal information:

  • Personal identifiers you provide when you apply for a job, supply information for your benefits, or in context of your employment with us, such as your first and last name, alias, address, email address, unique personal identifiers, online identifiers, account name, telephone number, date of birth, immigration and work authorization status, online identifier and account username, and signature. We collect this information to make an employment and/or job-related decision that involves you, to fulfill or meet the reason you provided the information as a job applicant or employee, to provide you with employment with us, to manage your employment relationship with us, and for general employee administration and processing, including employee payroll and benefits administration, to run background checks, and to determine your legal eligibility for employment.

  • Protected classification and diversity information such as age, citizenship, marital status, sex, gender, and veteran or military status. We collect this information to comply with local, state, and federal laws and regulations, to run background checks, and for purposes of your employment and benefits administration.

  • Financial information such as banking information for direct deposit, tax selections, pay rate, payroll deduction information, medical information, and health insurance information. We collect this information for employee-related human resource administration (including employee payroll and benefits administration), business expense reimbursement, processing work-related claims (for example, insurance or payment claims), all related accounting and auditing, and for employee product purchases.  

  • Physical characteristics or descriptions. We collect this information for purposes of administering safety and security programs, for employment records, administer health and Worker’s Compensation programs, and comply with applicable laws.

  • Benefit selection and related information such as your benefit selections and health insurance information. We collect this information to provide you and your dependents and beneficiaries with benefits, to administer benefit claims, and for employee-related human resource administration purposes.

  • Professional and employment-related information such as current or past employment history, employee status and title, job evaluations, employment status, work schedule, job assignments, hours worked, training and development information, performance evaluation information, information relating to skill and certifications, disciplinary and counseling information, and termination information. We collect this information to make employment and/or job-related decisions that involve you, to fulfill or meet the reason you provided the information as a job applicant or employee, to provide you with employment with us, to assess qualifications for a particular job or task, for education, training, and development requirements, and to contact your references and/or conduct background checks.

  • Education information such as education history, grades, transcripts. We collect this information to evaluate and make an employment and/or job-related decision that involve you, provide you with employment with us, obtain education verification, and assess your qualifications for a particular position, for training and development requirements, and educational reimbursement program.

  • Sensory data including hearing and respiratory data from participation in the hearing conservation and respiratory safety programs. We collect this information for purposes of managing our health and safety programs.

  • Internet or similar networking activity, including internet or other electronic network activity information, browsing history, search history, cookies, interaction with our website, online account activity, and download history. We collect this information to track and monitor employee use of company-owned computers.

  • Preferences and inferences drawn for other personal information, which may include preferences, characteristics, attitudes, and opinions. We collect this information to evaluate interest in company programs, benefits, and initiatives from aggregated results from answers to employee surveys.

  • Beneficiary Information of your beneficiaries and dependents, such as name and contact information, relationship to you, birth date, and any other information necessary to process benefits claims. We collect this information for purposes of benefits administration.

  • Emergency Contact Information of person(s) you designate as your emergency contact(s) such as their name and contact information, and their relationship to you. We collect this information to maintain contact information should an emergency involving you arise during your employment.

Sensitive Personal Information Collected

  • Identifiers, such as your (or your beneficiaries’) social security number, driver’s license number, California identification card, passport number. We collect this information to make an employment and/or job-related decision that involves you, to fulfill or meet the reason you provided the information as a job applicant or employee, to provide you with employment with us, to manage your employment relationship with us, and for general employee administration and processing, including employee payroll and benefits administration, to run background checks, and to determine your legal eligibility for employment.

  • Characteristics of protected classifications under California or federal law including race or ethnicity, color, national origin, physical or mental disability, or medical condition. We collect this information to comply with local, state, and federal laws and regulations, to run background checks, and for purposes of your employment and benefits administration.

  • Health and Safety Information such as health conditions, if relevant to your employment, job restrictions, workplace accident and illness information, and health insurance policy information. We collect this information to maintain a safe workplace, accommodate any disabilities, administer health and Worker’s Compensation programs, and comply with applicable laws.

  • Health information relating to the Covid-19 pandemic, including vaccination records, test results, daily health checks, symptoms, temperature scans, and exposure to the virus. We collect this information as part of our Covid response plan, and to ensure the safety and health of all of our employees.

  • Financial information including debit card number, credit card number, state identification number and social security number. We collect this information for employee-related human resource administration (including employee payroll and benefits administration), business expense reimbursement, processing work-related claims (for example, insurance or payment claims), all related accounting and auditing, and for employee product purchases.

  • Geolocation data that can be used occasionally to identify your physical location or movements. We collect this information to ensure employees that work onsite clock in and out within company premises.

  • Biometric information, including fingerprints. We collect this information for purposes of time keeping, employee time records, and payroll.

Data Retention

We retain your personal information and sensitive personal information in accordance with our data retention policies or for as long as is required by law.

Disclosure to Third Parties

Hyland’s Naturals does not sell or otherwise disclose your personal information to any third parties for any monetary consideration or financial benefit.  

Hyland’s Naturals discloses your personal information for business purposes to its service providers and vendors who perform business and human resource functions and services on our behalf, including running pre-employment background checks, for purposes of benefits brokering and administration, insurance carriers, timekeeping and payroll, retirement plan administration, and survey providers. Hyland’s Naturals only shares your personal information with its service providers to the extent necessary in order to fulfill the purposes of human resource administration as identified in this Privacy Notice or as required by law.  

Hyland’s Naturals may also disclose your personal information to government authorities or agencies when required or permitted to by local, state, or federal law. Hyland’s Naturals may also disclose your information for other legal reasons when permitted, including to protect our legal rights, and where necessary to protect the vital interests of any person.

California Rights

As a California resident you can make certain requests regarding your personal information. We will fulfill each of these requests per the requirements of California law.

You can request a copy of the personal information we have about you, including a list of categories of your personal information that we have shared with another company for a business purpose.

You can request that we correct or delete your personal information subject to certain exceptions.

Hyland’s Naturals reserves the right to update this Privacy Notice at any time. The Last Updated date reflected in this section indicates the last date this Privacy Notice was revised.
